Dear Sir/Madam, your data is safe with us. Sans Souci Wealth Management GmbH (hereinafter referred to as "We") is committed to protecting your data, and we take this responsibility seriously. With this notice, we would like to explain why and how we process your personal data (hereinafter referred to as "Data") and what data protection rights you have in relation to this processing.
1. PERSONAL DATA
We process your data that we receive from you as a business partner or prospect in the course of our business relationship. If you have subscribed to our newsletter, we process the data you provide for the purpose of direct marketing, advertising, and customer retention.
2. FOR WHAT PURPOSES DO WE PROCESS YOUR DATA AND ON WHAT LEGAL BASIS?
We process your personal data in accordance with data protection regulations. The processing of your data takes place for the fulfillment of pre-contractual measures and our contractual obligations towards you in accordance with Art. 6(1)(b) GDPR. The specific details of the contract execution can be found in the respective contract documents and terms and conditions. Furthermore, we process your data to fulfill our legal obligations in accordance with Art. 6(1)(c) GDPR. We also process personal data based on our legitimate interest in accordance with Art. 6(1)(f) GDPR for internal administration, documentation purposes, the assertion and defense of legal claims, as well as for a better and more user-friendly presentation of our website. Based on your consent given upon subscribing to the newsletter, we process your data in accordance with Art. 6(1)(a) GDPR for the purposes of direct marketing, advertising, and customer retention. This means that we will contact you via email with a personalised newsletter and inform you when we believe, based on your data, that information about offers, services, and events from us and our partner companies may be especially relevant and interesting for you. 3. HOW LONG WILL YOUR DATA BE STORED?
We only store your data for as long as it is necessary for the respective purpose for which we process your data:• For the fulfilment of our corporate and tax retention obligations, we retain personal data for the periods prescribed by these laws. For tax reasons, contracts and other documents are generally to be kept for seven years (§ 132 BAO). Retention periods can also extend to twelve years, for example, in the case of documents and records concerning real estate, and in some cases, up to 22 years for certain properties (§ 18 para 10 UStG). In addition, documents must continue to be stored even after the expiry of the retention period if they are involved in pending tax or court proceedings or other individual cases.• If we process your data based on our legitimate interest for internal administrative purposes, documentation, or for the assertion and defence of legal claims, we will promptly delete your data if you object to this processing (see point 9) or if our legitimate interest no longer applies. The periods for asserting or defending legal claims are derived from various laws (e.g., the Austrian Civil Code) and can last up to 30 years.
4. WHO WILL RECEIVE YOUR DATA?
To fulfil the purposes mentioned above, it may be necessary for us to share your data with independent tax advisors, accountants, lawyers, notaries, property management companies, or banks. Additionally, we may pass your data to service providers (as processors) whom we engage, particularly IT service providers, if they require your data to carry out their respective tasks. These recipients are either contractually, legally, or ethically obliged to treat your data confidentially and to process it only to the extent necessary for the provision of services.
5. ARE YOU OBLIGED TO PROVIDE DATA?
As we require your data to fulfil our contractual obligations, we regret that we cannot enter into a contractual relationship with you without the provision of this data.
6. USE OF COOKIES ON WWW.SANSSOUCI.AT
We use cookies on our website www.sanssouci.at (hereinafter referred to as the "Website"). Cookies are small files that your browser automatically creates and stores on your device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not harm your device and do not contain viruses, trojans, or other malicious software. The cookie stores information related to the specific device you are using to access our website. 7. AUTOMATED DECISION-MAKING
We do not use automated decision-making as defined in Article 22 of the GDPR to make decisions regarding the establishment or performance of the business relationship.
8. YOUR RIGHTS IN RELATION TO THE PROCESSING OF YOUR DATA
You have the right to:
• Request information at any time regarding which of your data is being processed by us (Article 15 GDPR);
• Have your data corrected or deleted (Article 16 GDPR);
• Request the restriction of the processing of your data (Article 18 GDPR);
• Withdraw your consent to data processing at any time (Article 7 GDPR);
• Object to the processing of your data (Article 21 GDPR);
• Request data portability (Article 20 GDPR).
If you believe that we are violating your rights under the GDPR or national data protection laws during the processing of your data, we kindly ask you to contact us. This will allow us to address your concerns as promptly as possible. You also have the right to lodge a complaint with the relevant data protection authority (in Austria: www.dsb.gv.at)
